Q: We present to your eminence that we are currently building a mosque on the Khurais road in al-Nasim, based on the attached permit. We have completed the ground floor and the first floor above it, but it has become necessary for us to add another floor so that it will be a ground floor, a first floor, and a second floor. This is due to the congestion of the area with residents and the scarcity of mosques in it. We submitted a request to the Municipality of Riyadh for a permit for the second floor, but they did not approve it on the grounds that it is not permissible religiously. We hope you will inform us whether it is religiously valid to build
the mosque on more than two floors?

A: It is permissible to build a mosque on two floors or more if the need calls for it. During prayer in it, it should be noted that the ma'mum (those praying behind the imam) should be as close to the imam as possible, even if they are behind him; this is based on the evidence indicating the superiority of the first row, then the next, and of being close to the imam. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
