The questioner : I am a woman who had an infant with me. When I traveled with my brother from Dammam to Riyadh, one of the tires burst, and the car overturned, and this infant died in this accident. My question, O honorableThe Shaykh : Do I owe an expiation for the death of that infant, because I fear that I may have been negligent? And what is the expiation?

The Shaykh : She does not owe an expiation. And she was not negligent. A woman who traveled with her child with her; this is not negligence. This is a common occurrence among people, and they do not consider her negligent. As for the driver of the car, it must be examined: Did the tire burst due to his negligence or his transgression? In that case, he is liable. But if it was not due to his negligence or his transgression, meaning that he may have inspected the car and did not find a defect in it, but the divine decree and destiny are above all things, then he owes nothing. And this happens often. Sometimes a tire bursts without any cause, neither from speed nor from overloading beyond capacity. But when Allah wills something, it happens, so he owes nothing. The rule is: - listen to it - "Every accident that is not due to the driver's negligence or his transgression, he owes nothing for it". Yes.
