Q: We have many graveyards, and some of them have white or black stones on them, and they build on them. They say that they do not build on the graves of men who were killed and who killed many people, and I heard them say that it is noble. So I say: That is an error, building on them. I have decided to demolish that. Is that permissible? And is there a punishment from Allah for it? Please inform us, may Allah reward you with good.
A: Building on graves is a denounced religious innovation, containing exaggeration in honoring those buried there, and it is a means to shirk (associating partners with Allah). It is obligatory for the ruler of the Muslims or his deputy to order the removal of what is on the graves and to level them with the ground; to put an end to this religious innovation and to block the means to shirk. Muslimin his Sahih, fromAbu al-Hayyaj Hayyan ibn HusaynHe said: He said to me'Ali(may Allah be pleased with him):, and it is established from him (peace and blessings be upon him) that he prohibited building over graves, plastering them, and sitting on them. However, do not do this on your own initiative, for fear that you may suffer harm before you have completed their removal. Rather, refer the matter to the judge of the region or its governor so that he may carry out what is obligatory upon him, namely demolishing them and warning the Muslims of their evil, for he is the deputy of the one in authority in this and similar matters. And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
