The first question of Fatwa No. ( 7350 ):
Q1: What is the interpretation of the saying of Allah the Exalted:[Al-Kahf 18:21] So what is meant by His saying: [Al-Kahf 18:21]
and[Al-Kahf 18:21] even though we have heard from you that building over graves is prohibited, is this not evidence for the permissibility of building over graves?
A1: The matter is as you have heard from us regarding the prohibition of building mosques over graves; due to the many pieces of evidence indicating this, and because it is a means to worshipping their people other than Allah. There is no evidence in the mentioned verse for building; because it is a narration of a past event and the action of people, and the evidence of the Shari'ah indicates the opposite of that and condemns them for it. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

And similarly, We caused them to be found that they [who found them] would know that the promise of Allah is truth and that of the Hour there is no doubt. [That was] when they disputed among themselves about their affair and [then] said, "Construct over them a structure. Their Lord is most knowing about them." Said those who prevailed in the matter, "We will surely take [for ourselves] over them a masjid."
وَكَذَلِكَ أَعْثَرْنَا عَلَيْهِمْ لِيَعْلَمُوا أَنَّ وَعْدَ اللَّهِ حَقٌّ وَأَنَّ السَّاعَةَ لاَ رَيْبَ فِيهَا إِذْ يَتَنَازَعُونَ بَيْنَهُمْ أَمْرَهُمْ فَقَالُوا ابْنُوا عَلَيْهِمْ بُنْيَانًا رَبُّهُمْ أَعْلَمُ بِهِمْ قَالَ الَّذِينَ غَلَبُوا عَلَى أَمْرِهِمْ لَنَتَّخِذَنَّ عَلَيْهِمْ مَسْجِدًاConstruct over them a structure
