Q1: The laws in force in Egypt allow pharmacists the right to own only two pharmacies, and some fellow pharmacists are not content with that, but rather want to increase, so it is possible for a pharmacist to have three or four pharmacies, but they overcome the strictness of the law regarding pharmacy licenses. This pharmacist who wants to own more than two pharmacies resorts to agreeing with another pharmacist who owns no pharmacy or owns one pharmacy to give his name as the owner of the third pharmacy for the first pharmacist who wants more pharmacies, so that in exchange for a sum of money the first pharmacist gives him monthly or annually, so what is the ruling in Islam on this agreement and this money? Is it false testimony, or is it a means of cooperation to remove hardship from the interests of the people and to get out of the strictness of man-made laws? We ask for your information.
A1: The aforementioned agreement is not permissible; because of the lying, falsehood, and deception of the authorities and tricking them in a regulation that considered the interest of the people and did not contradict any scriptural evidence. Then the parties to the agreement are in danger if their matter is exposed. And on this basis, the money that the one who obtained a third pharmacy through this agreement gives
to the other pharmacist monthly or annually, for example, in exchange for this operation - is forbidden. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
