The Shaykh : Some scholars hold that abandoning Hajj is disbelief. They cite the saying of Allah, Blessed and Exalted is He:
And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a way. But whoever disbelieves - then indeed, Allah is free from need of the worlds. وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنْ اسْتَطَاعَ إِلَيْهِ سَبِيلاً وَمَنْ كَفَرَ فَإِنَّ اللَّهَ غَنِيٌّ عَنْ الْعَالَمِينَ
[Ali 'Imran 3:97]

meaning: so he did not perform Hajj. This is a narration from Imam Ahmad. It is also narrated from the Commander of the Faithful, 'Umar ibn al-Khattab (may Allah be pleased with him), that he said:

They are not Muslims, they are not Muslims. لقد هممت أن أبعث إلى هذه الأمصار. فمن وجدوه ذا سعة ولم يحج فليمت يهودياً أو نصرانياً. ما هم بمسلمين ما هم بمسلمين

In that case, it is obligatory to pay the zakah if he has wealth, because zakah is a right of the poor, unlike Hajj. In any case: he is in great danger. If he had the means and did not perform Hajj, he is in great danger. Yes.
