Continuation of the Debate: The Legislator of Rulings Either Permits It in Heart and Deed, or He Does Not

Machine translationRead the Arabic original
The questioner : Please, Professor.

Another questioner : The example.

The Shaykh: Yes.

The questioner : Regarding legislation, a person who believes that Allah is One and has no partner legislates a law in the economic, social, moral, or political system; he legislates a law, writes a statute, and so on.

The Shaykh: Yes.

The questioner : Is this example in accordance with what you mentioned? I asked you.

The Shaykh : No, this example is not in accordance with...

The questioner : Please, why not?

The Shaykh : This example is for disbelief of the heart.

The questioner : Why?

The Shaykh : Because he permitted what Allah has forbidden. Regrettably, the example does not go beyond that; he permitted what Allah has forbidden. Allah says:
Or have they other deities who have ordained for them a religion to which Allah has not consented? أَمْ لَهُمْ شُرَكَاءُ شَرَعُوا لَهُمْ مِنَ الدِّينِ مَا لَمْ يَأْذَنْ بِهِ اللَّهُ
[Ash-Shuraa 42:21]
, so this person permits legislating what Allah has not authorized.

The questioner : And what is the evidence for this that he permitted it?

The Shaykh : Fine, I will illustrate two scenarios for you.

The questioner : Please.

The Shaykh : Because you are asking me what the evidence is for which scenario you mean, and you are demanding evidence. Listen to me... be patient with me for a moment. A man who drinks intoxicants has disobeyed Allah without doubt, and a man who permits drinking intoxicants in his heart has disobeyed Allah twice: once in the practical aspect and once in the legislative aspect. Do you understand this statement?

The questioner: Yes.

The Shaykh : Fine, is the one who drank intoxicants without permitting them in his heart a disbeliever?

The questioner : He is not a disbeliever.

The Shaykh : Fine, is the one who permitted intoxicants in his heart and deed a disbeliever?

The questioner : A disbeliever.

The Shaykh : We have returned to the previous discussion without any new example. Allow me to finish. The one who legislates for people from himself what Allah has not authorized, has he not set himself up as a Lord over the servants in place of the Lord of the Worlds (Blessed and Exalted is He)?

The questioner : He set himself up as a god, but in his heart he tells you, "I am a believer in my heart, certain and believing."

The Shaykh : For what?

The questioner : With everything the legislator says, but I wrote this actually so that you would follow.

The Shaykh : Fine, now this detail is what the discussion will revolve around. This is what he wrote for the people.

The questioner: Yes.

The Shaykh : Does he believe in his heart that the legislation he enacted for them is correct or incorrect?

The questioner : He says: "I am certain in Allah (Mighty and Majestic), and I legislated this for the sake of public benefit."

The Shaykh : ... Oh, my professor.

The questioner : Please.

The Shaykh : The best speech is what is brief and effective. I say: does he believe in his heart that this legislation he enacted for the people is correct or incorrect? I hope the answer is "correct" or "incorrect." Our friend here does not want this method, so please clarify the method so that I can proceed with you.

The questioner : Meaning, you want to assert that his heart is such and such.

The Shaykh : I do not assert this for a specific person, oh my dear professor. I am assuming two persons; I do not name them Zayd or 'Amr.

The questioner: Yes.

The Shaykh : And there is absolutely no third possibility.

The questioner: Yes.

The Shaykh : Meaning, all the people who contradict the laws, or the Shari'ah in the more accurate sense, cannot be imagined to have any image other than one of two images, and without specifying individuals.

The questioner: Yes.

The Shaykh : A type of these persons permits what Allah has forbidden in his deed, and another type permits what Allah has forbidden in his heart and deed. What do you say? You ask me, "What is your knowledge of this?" No, I am not saying Zayd and 'Amr. No, all those who disobey Allah (Mighty and Majestic) do not exceed these two possibilities in reality: either he permits what Allah has forbidden, and this includes legislating this law... and others, permitting it in heart and deed, in which case he is an apostate without doubt by the consensus of the scholars of the Muslims; or he permits it in deed. So, to clarify this point, I ask you: this person whom you say has established legislation for the people and commanded them to do so, and so on, does he say that his legislation is correct while knowing that it contradicts the Shari'ah of the Lord of the Worlds, or does he rule that it is incorrect and that the correct one is the legislation of Allah?
