The Shaykh : The second question: The Prophet (peace and blessings be upon him) said in the hadith in which it is mentioned that he sent Mu'adh to Yemen:
tell them that Allah has made the payment of Zakat obligatory upon them. It should be collected from their rich and distributed among their poor. فأعلمهم أن الله افترض عليهم صدقة تُؤخذ من أغنيائهم وتُرَدُّ إلى فقرائهم

Does this hadith imply that zakah is a right of the poor from the wealth of the rich, and therefore reaching puberty is not a condition for it? Or is it considered an act of worship for which reaching puberty is a condition, as with other acts of worship? The answer is that this issue is a matter of scholarly disagreement among the scholars of Islamic jurisprudence. The stronger position is that zakah is not taken from the wealth of a minor who has not reached the age of legal responsibility. This is for two reasons. The first and most important reason is that charity purifies the person through it, as our Lord (Mighty and Majestic) explicitly stated in the Qur'an:
Take, [O, Muhammad], from their wealth a charity by which you purify them and cause them increase, and invoke [Allah 's blessings] upon them خُذْ مِنْ أَمْوَالِهِمْ صَدَقَةً تُطَهِّرُهُمْ وَتُزَكِّيهِمْ بِهَا وَصَلِّ عَلَيْهِمْ
[At-Tawbah 9:103]
Since the minor is not legally responsible, he is not defiled or stained by sins and transgressions. Therefore, he does not need to have his wealth purified by paying zakah. The second reason is that the wealth subject to zakah, especially if it is static wealth not used for trade, will eventually decrease, though we do not say it will disappear entirely. The guardian of the minor's wealth will continue to spend from it, and it will diminish and diminish. This can happen in circumstances where the guardian of the orphan may not be able to utilize the wealth and trade with it. If he is able to utilize the wealth and trade with it, that is better and in the interest of the minor who has not reached puberty. However, zakah is not obligatory on his wealth due to the evidence mentioned earlier.
