Because zakah is a right of the wealth,Allah the Exalted said:
(24) And those within whose wealth is a known right (25) For the petitioner and the deprived -وَالَّذِينَ فِي أَمْوَالِهِمْ حَقٌّ مَعْلُومٌ * لِلسَّائِلِ وَالْمَحْرُومِ
[Al-Ma'arij: 24-25] , and the Prophet (peace and blessings be upon him) said to Mu'adh when he sent him to Yemen: (Inform them that Allah has made obligatory upon them a charity in their wealth, to be taken from their rich and returned to their poor) ,And the saying of Abu Bakr (may Allah be pleased with him): [Zakah is a right of the wealth] so it is of the same kind as maintenance; it is obligatory in the wealth of a minor and in the wealth of a person of unsound mind, just as maintenance is obligatory for those upon whom it is due.For example: If the minor has a poor mother, maintenance is taken from his wealth for his mother, and if he has a wife, maintenance is taken from his wealth for his wife. So likewise, zakah is a right for its recipients in the wealth of this minor or in the wealth of this person of unsound mind.
