Q: A wealthy man did not pay the zakat of his wealth for any of the years of his life
and he died
, and the heirs want to ask Your Eminence: 1- Is this inherited wealth lawful and good, and is it permissible for them to eat it comfortably? 2- Or is it obligatory for them to pay the zakat of their father's wealth for the years of his life, even if it consumes the entire wealth? 3- Or is paying the zakat of their father's wealth merely a matter of dutifulness to parents?

A : If their father was a Muslim, and they know with certainty that he did not pay the zakat of his wealth, then it is obligatory for them to pay it for all the years; because it is considered a debt in the liability of their father, and the debt of Allah is more deserving of being paid. If there is a minor among them, what pertains to the zakat of their share is referred to the court to take whatever action it deems appropriate in that regard. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
