The questioner : And this questioner says: Some pilgrims, after entering the state of ihram and reaching the inspection points, proceed to remove their ihram garments and put on their regular clothes because they have not obtained a Hajj permit. If they pass the checkpoint, they put on their ihram garments again and then offer a fidyah (expiation). What is your ruling regarding these people?

The Shaykh : Our ruling regarding these people is that they have erred. They erred in that they deceived the state by violating the regulations.
Secondly, they disobeyed the Prophet (peace and blessings be upon him) with an open act of disobedience. The Prophet (peace and blessings be upon him) said:
A Muhrim should not wear a shirt لا يلبس المحرم القميص
Sahih al-Bukhari 5794
And these people wore it. So it is as if he is declaring by his action his disobedience to the Messenger (may Allah’s peace and blessings be upon him). And it is astonishing that these people treat the signs of Allah as play for a Hajj that is not obligatory upon them. The government did not prevent them from performing Hajj; rather, it organized the Hajj. How can they deceive the government by appearing as if they are not in the state of ihram, and disobey Allah and His Messenger by wearing a shirt? I am truly astonished. If I were to inspect, and I have not inspected, I would see people like these who have been afflicted with disobedience to Allah and His Messenger and deception of the state. If I were to look into them, I would find much negligence in matters greater than this. Yes.
