The father's prevention of seeing his daughter
Machine translationRead the Arabic original
Question: My nephew married my daughter more than twenty years ago, and now he refuses and prevents me from seeing my daughter and my daughter's daughters. What is the ruling of the Shari'ah in this matter? Please inform us, may Allah reward you all with good.
Answer: Allah, Glorified and Exalted is He, has commanded maintaining family ties and forbidden severing them. Therefore, what you mentioned about your daughter's husband preventing you from seeing her and her children is not permissible, because it compels you to sever the family tie and stands between you and maintaining the family tie that Allah has made obligatory for you to maintain. Furthermore, it deprives you of seeing your grandchildren, despite the father's compassion for his children and his eagerness to see them. Thus, he stands between you and your children, and he is sinful in doing so, unless he has a valid Shari'ah excuse that justifies it, such as if seeing them or allowing you access to them would lead to harm. In that case, there is a basis for it, and he may prevent it.
However, if there is no harm, it is forbidden for him to stand between a relative and his relative, especially a father and his children. And Allah knows best.
