If a pilgrim buys his sacrificial animal and ties it in his tent, then it escapes and gets lost among the tents and he cannot find it, is he obligated to buy another sacrificial animal in its place, given that he is a poor man who lacks the means of maintenance, or is there a dispensation in this matter?

The questioner : If a pilgrim buys his sacrificial animal and ties it in his tent, then it escapes and gets lost among the tents and he cannot find it, is he obligated to buy another sacrificial animal in its place, given that he is a poor man who lacks the means of maintenance, or is there a dispensation in this matter? We ask for a satisfying answer. May Allah guide you?

The Shaykh : This sacrificial animal that escaped does not suffice him; rather, it is obligatory for him to buy a replacement for it. If he cannot find one, then, as Allah the Exalted said, he must fast three days during Hajj and seven days when he returns to his family. If he buys a replacement and then finds the original one afterwards, it is his property, and he may dispose of it as he wishes.

The questioner : Yes.

The Shaykh : Because he slaughtered the replacement, the replacement takes the place of the original, and it is not obligatory for him in this case to slaughter the original one, because his liability was discharged by slaughtering the replacement.

The questioner : Well done.
