The questioner : And he informed you that we have graveyards, and a lot of filth or garbage is placed on them, which is unimaginable, and this is not pleasing to Allah or His Messenger, and this affects the hearts of the believers. So I ask your Eminence to guide us and advise those who place this filth on the graveyards?

The Shaykh : Praise be to Allah, Lord of the worlds, and blessings and peace be upon our Prophet Muhammad, and upon his family and his Companions and those who follow them with excellence until the Day of Judgment. There is no doubt that the graveyards of Muslims must be respected and protected from harm. It is established from the Prophet (peace and blessings be upon him) that he forbade plastering graves and sitting on them, and he said
It is better that one of you should sit on live coals which burn his clothing and come in contact with his skin than that he should sit on a grave لأن يجلس أحدكم على جمرة فتخرق ثيابه فتمضي إلى جلده خير له من أن يجلس على القبر

The Shaykh : And from this hadith, it is understood that anything that constitutes humiliation for the people of the graves is something from which the Shari'ah has warned and threatened. The obligatory thing in such a situation is that whoever sees this in the graveyards of Muslims should contact those responsible for maintaining the graveyards.

The Shaykh : And inform them of this so that they may maintain and protect them from these harmful things.

The questioner : Yes.

The Shaykh : Also, it is obligatory for him to advise whoever he sees throwing garbage in them, and to make it clear to him that this is the abode of his believing brothers, and that it is not only not recommended, but not permissible, to throw in it anything that constitutes humiliation for them and a failure to uphold their rights. The Lawgiver, just as He forbade the humiliation of graves, also forbade their exaltation, as in plastering and building. So it is not permissible to exalt graves by building on them, plastering them, or erecting large, prominent, visible markers. For Ali ibn Abi Talib said to Abu al-Hayyaj: Shall I not send you with what the Messenger of Allah (peace and blessings be upon him) sent me with?

The questioner : O Allah, send blessings and peace upon him.

Spare no portrait unwiped out, and leave not a high grave unlevelled. ألا تدع صورة إلا طمستها ولا قبرا مشرفا إلا سويته

And many of the graves, we see that some people place large markers on them.

The questioner : Yes.

The Shaykh : Large, long, protruding stones. So this is also not recommended. The markers in the graveyard should only be what is sufficient to indicate the occupant of the grave. As for making them large, whitening them, or painting them red with paint or the like, this is not recommended. The religion is a middle path.
