The questioner : Before the last question; he saysThe questioner : What is the ruling on one who leaves the witr prayer intentionally or forgetfully? And does he have to make it up?

The Shaykh : As for the one who leaves the witr prayer intentionally, in that he has no way to make it up outside of its time, he is like the one who leaves an obligatory prayer that he has no way to make up after its time has passed. As for the one who sleeps through the witr prayer, his ruling is the opposite of that; it is like the one who sleeps through a prayer. So if a person sleeps through the witr prayer and wakes up after the Fajr adhan, he may pray the witr before the Fajr sunnah, provided that he has enough time such that he does not miss the congregational prayer with the congregation in the mosque. Or he may delay making up the witr until the late morning, after the sun has risen the height of two or three meters. So the answer regarding the one who leaves the witr prayer intentionally or forgetfully is that his case is the same as the one who leaves a prayer intentionally, forgetfully, or while sleeping. The one who has an excuse makes it up, and the one who has no excuse does not make it up.
