The questioner : Before the final question, the questioner asks: What is the ruling on one who intentionally or forgetfully leaves off the witr prayer, and is he required to make it up?

The Shaykh : One who intentionally leaves off the witr prayer has no means of making it up outside its time, so he is like one who leaves off an obligatory prayer with no means of making it up after its time has passed. As for the one who sleeps through the witr prayer, his ruling is the opposite of that, like the one who sleeps through a prayer. If a person sleeps through the witr prayer and wakes up after the Fajr adhan, he may pray the witr before the Fajr sunnah, provided there is enough time so that he does not miss the congregational prayer with the congregation in the mosque. Or the latest time to make up the witr is the duha time, after the sun has risen the height of two or three meters. So the answer regarding one who leaves off the witr prayer intentionally, or by mistake, or forgetfully, is that his case is the same as one who leaves off a prayer intentionally, or forgetfully, or while sleeping. The one who has an excuse makes it up, and the one who has no excuse does not make it up.
