If a man orders his wife to do forbidden things, such as pouring him intoxicants, for example

Machine translationRead the Arabic original
The questioner : There have been several questions regarding a woman whose husband demands or orders her to do forbidden things, such as pouring him intoxicants, for example, or having intercourse with her in a manner other than for procreation or otherwise, and forces her to do so. Is divorce the solution?
Also, what is the action to take if the source of the husband's wealth is through a forbidden, non-prescribed means, such as riba (usury or interest) or other such matters? Does she separate from him? Or does she live with her children on haram (forbidden) wealth?

The Shaykh : If she has a legal path—unfortunately, because the Shari'ah is not enforced in many cases today—if she has a legal path that helps her file a lawsuit against her husband, on the grounds that he orders her to disobey Allah (Mighty and Majestic) in many matters as mentioned in the question, including that he earns his wealth from haram (forbidden) sources or riba (usury or interest), and she is compelled by living with him to eat this haram (forbidden) wealth. And he (peace and blessings be upon him) said:
Hell is more fitting for him whose flesh is nourished by what is unlawful. كلُّ جسدٍ نبتَ من السُّحت فالنار أولى به
Mishkat al-Masabih 2825Sahih (Al-Albani)
; therefore, out of that, she fears for herself from the Fire, so she brings her case to the Shari'ah judge. If he accepts her complaint, and then this judge is able to take hold of that husband to fear Allah (Mighty and Majestic) regarding her, and not to order her to do something that contradicts the Shari'ah, and not to feed her from his haram (forbidden) wealth; that is what we hope for. And if the other, meaning the judge, in such a lawsuit does not even look at it, or if he accepts her lawsuit but is unable to... fulfill her need, then at that time she must hasten to seek separation from her husband; because it is not permissible for her to live on these forbidden things, which are darknesses, one upon another.
