The questioner : There are several questions that have come in regarding a woman whose husband demands or orders her to do forbidden things; for example, pouring him intoxicants, or having intercourse with her in a manner other than for procreation, or other such things, and he forces her to do so. Is divorce the solution? Also, what is the action if the source of the husband's wealth is through a forbidden, non-prescribed means, such as riba (usury or interest) and other such matters? Does she separate from him, or does she live with her children on his forbidden wealth?

The Shaykh : If she has a legal path—unfortunately, because the Shari'ah is not enforced in many cases today—if she has a legal path that helps her file a lawsuit against her husband on the grounds that he orders her to disobey Allah (Mighty and Majestic) in many matters, as mentioned in the question, including that he earns his wealth from what is forbidden or from riba (usury or interest), and she is compelled, because of living with him, to eat this forbidden wealth. The Prophet (peace and blessings be upon him) said:
Hell is more fitting for him whose flesh is nourished by what is unlawful. كلُّ جسدٍ نَبَتَ من السُّحتِ فالنار أولى به

; therefore, she fears for herself the Fire, so she brings her case to the Shari'ah judge. If he accepts her complaint and then this judge is able to compel that husband to fear Allah (Mighty and Majestic) regarding her, and not to order her to do anything that contradicts the Shari'ah, and not to feed her from his forbidden wealth; that is what we hope for. But if the judge does not even look at such a lawsuit, or if he accepts her complaint but is unable to remove... then she must hasten to seek separation from her husband; because it is not permissible for her to live on these forbidden things, which are darknesses, one upon another.
