The questioner : There are several questions that have come in regarding a woman whose husband demands or orders her to do forbidden things, such as pouring him intoxicants, or having intercourse with her in a manner other than for procreation, or other such matters where he forces her to do so. Is divorce the solution? Also, what is the action if the source of the husband's wealth is a forbidden, non-prescribed path, such as riba (usury or interest) and other such matters? Does she leave him, or does she live on his forbidden wealth along with her children?

The Shaykh : If she has a legal path—and unfortunately, the Shari'ah is not applied in many cases today—if she has a legal path that helps her file a lawsuit against her husband because he orders her to disobey Allah the Exalted in many matters, as mentioned in the question, including that he earns his wealth from what is forbidden or from riba (usury or interest), and she is compelled by her life with him to eat this forbidden wealth. The Prophet (peace and blessings be upon him) said:
Hell is more fitting for him whose flesh is nourished by what is unlawful. كل جسد نبت من السّحت فالنار أولى به
Mishkat al-Masabih 2825Sahih (Al-Albani)
Therefore, out of fear for herself from the Fire, she brings her case to the Shari'ah judge. If he accepts her complaint and this judge is able to compel that husband to fear Allah the Exalted regarding her, and not to order her to do anything that contradicts the Shari'ah, and not to feed her from his forbidden wealth, then that is what we hope for. But if the judge does not look into such a lawsuit, or if he accepts her complaint but is unable to remove... then in that case, she must hasten to seek separation from her husband, because it is not permissible for her to live on these forbidden things, which are darknesses, one upon another.
