What is the ruling on praying in a mosque that contains three graves, which are claimed to be those of the Companions Salman and Hudhayfah (may Allah be pleased with them both)?

Machine translationRead the Arabic original
The questioner : It is surrounded by a wall. Inside the wall, there is a large prayer area. Next to this prayer area, there are three graves. One is the grave of Salman, as they claim, and the grave of Hudhayfah is between them (may Allah be pleased with him). I do not recall the name of the third one. So, what is the ruling on praying in this mosque?

The Shaykh : It is not permissible.

The questioner : It is not permissible.

Another questioner: Peace be upon you.

The Shaykh : And upon you be peace, and the mercy of Allah and His blessings.

The questioner : Shaykh, can you clarify the picture for me, or is it clear, if Allah wills?

The Shaykh : If you want me to clarify what you have clarified for me, I will clarify what you have clarified for me, to test whether I understood you or not. Is it that this mosque has an unshaded courtyard—I am stating what I understood; you did not use this word—an unshaded courtyard, and there is a built mosque with a roof. This courtyard is enclosed by a wall. Inside this wall, in the courtyard and not in the same roofed mosque, are those three graves: the grave of Salman, the grave of Hudhayfah, and the third one whose name you do not remember. Is that correct?

The questioner: Yes.

The Shaykh : The answer is what you heard.

Another questioner: Peace be upon you.

The Shaykh : And the reason—and upon you be peace and the mercy of Allah—is that this description applies to a case where praying in it is considered as the mosque having been built over a grave and prayers being offered in it. The mass-transmitted hadiths that warn against praying in mosques built over graves, whether they narrate this as a practice of the Jews or the Christians or both groups, or are a direct warning from him (peace and blessings be upon him) to his Ummah, all these hadiths include this type of mosque. Because it is true that they took their graves as mosques. This is unlike the case where these graves are not built inside the wall but outside the wall. In that case, the expression by al-Nawawi mentioned earlier does not apply to this type of mosque. That is, we distinguish between the grave being outside the mosque and being inside the mosque. We do not distinguish between it being inside what they call the Haram—that is, the roofed mosque—and it being in the open space and courtyard of the mosque, which is part of the mosque.
