The ruling on praying in a mosque that contains graves and the call to prayer therein
Machine translationRead the Arabic original
A message was received for the program from the listener: Abdul-Muttalib Abdul-Rahman Hussein from Sudan. He says: We have a congregational mosque, but there is a room adjacent to the mosque courtyard, and inside it are two graves. They offer material and financial vows to them, and they believe that the buried ones are from the lineage of the Prophet (peace and blessings be upon him). What is the ruling on praying in this mosque? Also, inside the enclosure there are places like a prayer area for the times; what is the ruling on praying in that place as well? Knowing that I want to call these people to Allah (Mighty and Majestic), but due to the presence of the two graves, I stopped calling in this mosque. What should I do? Please guide us, may Allah reward you with good?
Answer: If the two graves are outside the mosque enclosure, there is no harm in praying in the mosque. It is recommended that the mosque congregation and the officials work to transfer their remains to the public cemetery so that the mosque is free from the doubt that causes some people to stop praying in it. The prohibition applies only if they are in the mosque and the mosque was built over them; because the Messenger (peace and blessings be upon him)Sahih Muslim 529 If the two graves are outside the mosque to the right, left, west, or east, and are not inside it, there is no harm in praying in it. However, if they are inside the mosque and inside the mosque enclosure, then no. If the mosque was built over them, meaning: to honor them, then if they were found in it after its construction, they should be dug up. Likewise, if there are more, they are dug up and transferred to the cemetery and do not remain in the mosque, and prayer is performed in the mosque. But if it was built over the graves, then it is the one that is demolished, and the graves remain exposed to the sun, with no mosque in them and no prayer around them; because the Messenger (peace and blessings be upon him) forbade that. He said: Sunan an-Nasa'i 760Sahih (Darussalam) And he said: Sahih Muslim 532 And he said: Sahih Muslim 529.
So it is obligatory for the people of faith to be cautious of that, and not to build over mosques or make them graves, and not to bury the dead in mosques. Rather, it is obligatory that the dead be with their brothers in the cemeteries.
And it is obligatory that mosques be free of that and far from doubt. This is what is obligatory for Muslims. However, the prayer is valid if the grave is outside the mosque, outside the mosque enclosure. But if it is inside the mosque, then no prayer is performed in it and the prayer is not valid. Yes.
The presenter: May Allah reward you with good. So what is the ruling on the call to prayer in this mosque, given the situation described?
The Shaykh: If he comes to call them to Allah, there is no harm as long as the two graves are outside the mosque. But if they are in the mosque, then he calls them to leave praying in the mosque, and if it was built over the grave, he calls them to demolish it and remove it, and he contacts the officials so that it is removed.
But if the two graves are newly made in the mosque, and the mosque is the previous one, then they are transferred. Likewise, if there are more than two graves, they are dug up and transferred to the public cemetery, and prayer is performed in the mosque after that, and there is no blame; because it is an occurrence in the mosque, so it has no ruling, rather it is dug up. Yes.

Allah cursed the Jews and the Christians that they took the graves of their prophets as mosques
لعن اليهود والنصارى اتخذوا قبور أنبيائهم مساجدDo not pray toward graves and do not sit on them.
لا تصلوا إلى القبور ولا تجلسوا عليهاBeware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.
ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد، ألا فلا تتخذوا القبور مساجد فإني أنهاكم عن ذلكAllah cursed the Jews and the Christians that they took the graves of their prophets as mosques
