The Shaykh : The fourth characteristic: "And one who openly commits open sinfulness":
"And one who openly commits open sinfulness"; a person who drinks intoxicants openly, neither fearing Allah nor being ashamed of the servants of Allah. This is the open sinner who openly displays his open sinfulness. So he is to be backbitten; it is said: So-and-so is drinking intoxicants, he is not ashamed of people at all. This falls under the general text: ? In terms of meaning, it falls under it, but in terms of the specific evidences, this type is excluded from that general text. This is the open sinner who declares his open sinfulness and his lewdness. For example, So-and-so is a bar, a public place. This is never forbidden backbiting; this is excluded from forbidden backbiting.
