The Shaykh : This is an example of those examples, and perhaps all those present know what the sale of 'inah is; it is one of the sales involving riba, and it is something by which some Islamic countries have been afflicted today. The Messenger (peace be upon him) says explicitly in this hadith: ; that is, because of their disobedience to Allah (Mighty and Majestic) in some of what He has prescribed, this is what justifies Allah sending down humiliation upon the disobedient. He mentioned, by way of example, what brings about the harm of the Muslims, the sale of 'inah. I say this was mentioned by way of example, not by way of specification, and it is an example of many rulings that some people make permissible by way of ta'wil (figurative interpretation) or by way of deception. So the sale of 'inah is called a sale, and some of them may cite as evidence for it His saying (Blessed and Exalted is He): [Al-Baqarah 2:275], and they say: Why do you prohibit the sale of 'inah, when this is a sale covered by the text of the noble verse? We say: Allah (Mighty and Majestic) addressed His Prophet (peace and blessings be upon him) in some of what He addressed him with, saying: [An-Nahl 16:44], so the sale mentioned in the previous verse must be understood from the Sunnah of the Messenger (peace be upon him) and his sayings. And since he prohibited the sale of 'inah, it is not permissible for us to include this type of sale in the generality of His saying (Blessed and Exalted is He): [Al-Baqarah 2:275].
The sale of 'inah is a form of trading that the one in need of borrowing a sum of money resorts to, knowing that because of the corruption of society, the Muslims today do not have among them that strong bond of faith that would lead some of them to support their poor or needy brother. The good loan, the loan for the sake of Allah (Mighty and Majestic), has disappeared among the Muslims today. And since the affliction of the love of money and its accumulation has become widespread, even among the poor, even among those weak in material means, they resort to borrowing money by an unlawful means. Among these is the sale of 'inah. The sale of 'inah is when the man in need of a loan goes to a large merchant, and let us suppose this merchant is a car dealer, for example, or a rice dealer, or a sugar dealer, or something similar. He asks the merchant to buy a car from him, and they agree on an installment price that is higher than the cash price. So he buys the car, for example, for twenty thousand dinars, while its cash price is seventeen or eighteen thousand. Twenty thousand is recorded in the ledger as the price of this car, and the truth is that the one who came to buy the car has no need for the car; he wants to take money. So how does he get the money? After buying the car for twenty thousand on installments, this buyer returns to sell this car to the seller, the merchant himself. He sells it to him for less than what he bought it for, but he sells it for cash, whereas he bought it on credit, i.e., on installments. They agree, for example, to give him eighteen thousand, so he takes it and leaves with it, while twenty thousand is recorded against him. This is pure riba, but the sale was introduced as a means to make permissible what Allah (Blessed and Exalted is He) has forbidden. So the Messenger (peace and blessings be upon him) warned his ummah (the Muslim community) from this sale which involves deception regarding what Allah (Mighty and Majestic) has forbidden of riba.
I said: And this is an example, and the Messenger (peace be upon him) did not mention it by way of specification, but rather by way of illustration of some of the rulings that some people follow in order to deceive regarding the rulings of Allah (Mighty and Majestic).
If you trade with the sale of 'inah, Allah will inflict upon you a humiliation.
إذا تبايعتم بالعينة سلَّط الله عليكم ذلًّاBut Allah has permitted trade and has forbidden interest
