Explanation and elaboration on the hadith: "If you trade with one another through 'inah"

Machine translationRead the Arabic original
The Shaykh : These people embraced Islam, but... [unclear]... without Islam. And today, as long as we live amidst old and new sectarian differences, when we hear this hadith and admonish people with it, saying, "May Allah impose upon you a humiliation that He will not remove from you until you return to your religion," a good questioner asks us: Which religion? With what concept do we want to return? To the concept of the Salaf or the Khalaf? Hanafi, Shafi'i, Maliki, or Hanbali? Tariqa, Sufi, or Salafi? All these differences exist and are established. By Allah, we do not know Islam. Islam is just massive propaganda and very loud voices saying, "Return to your religion," but what is the religion? We do not know it. This is something that neither we nor you nor your fathers understand. Therefore, we focus on this point and say that the first duty of Islamic preachers is to educate Muslims and remind them of Islam in the meaning that the righteous Salaf had, in terms of creed, ruling, character, and upbringing. This hadith, in reality, indicates what we hold: there must be correct understanding and correct action. Where does the correct understanding indicated by this hadith come from? He says at the beginning of the hadith, "If you trade with one another through 'inah." Many Muslims trade with one another through 'inah and do not see any harm in it. What is 'inah? 'Inah is derived from the essence of a thing, meaning its very self. It is when a need is sold and bought in one session at two different prices: a higher price, which is the first price, and a lower price, which is the second price, excluding riba.
How much is the car? Is it on installment or cash? On installment, not cash. Ali, its cost to him is twenty thousand. He sells it for twenty-five thousand. This is an installment sale, and it is going on today. No one is bothered by it in the name of Islam. It is not like those who deal in riba, who take and borrow from banks. May Allah have mercy on us, we are forced to do so, and we need to build a house, and so on, with such excuses. But the installment sale is pure halal... it is not like the famous riba that is forbidden. This is the installment sale.
It is an introduction to the sale of 'inah. How much is the car? Twenty-five thousand on installment. He bought it from so-and-so for twenty-five thousand. A little while later, the car has not moved from its place. The buyer becomes the seller, and the seller becomes the buyer. The buyer says to the merchant, the seller, "I will buy this car from you for cash." How much? Nineteen thousand. The merchant is safe from the lawful profit and the extra profit. In exchange for what? The installment from the twenty-five thousand. So he returns with a third profit on top of the previous two profits. He buys it from him for less than what he bought it for from that place. He did not come with the intention of buying, and they do not need a car. He needs money. No one will give him a loan for the sake of Allah, and the right is upon him and upon them. Why? Because there is no trust between Muslims. One gives another twenty thousand like this for the sake of Allah... the problem is... therefore, he needs money. Satan makes it easy for him: "Go, buy in the name of installment and sell in the name of cash. You will take what you can." And how much do you record against him? Twenty-five thousand. As I told you, this merchant ate riba multiplied many times over. He became more wicked than the biggest Jew who takes from a hundred, two hundred and a half, or five, or something like that... very much in the name of installment. And this installment sale, they made it permissible in the name of what?
And Allah has made lawful sale and forbidden riba وأحل الله البيع وحرم الربا
And this is a sale, my brother. Not every sale is made permissible by Allah. So the hadith came to warn the Muslims that if they fall into such a deviation in understanding some issues—issues of religion from one side—and this is through the sale of 'inah, and this was mentioned by way of example, not by way of narration. Otherwise, there is no difference between the sale of 'inah and the marriage of tahil. They call it... among the common people, there is absolutely no difference. So, just as they made the sale of 'inah permissible, they also made the marriage of tahil permissible.
And there is no difference between this and that, and the trick that you remember in some of the Hanafi books, where a rich man, for example, has twenty gold liras or more. He puts them in a bag of salt, or a bag of sugar, a bag of salt, and he gives it to the poor man. He says, "Come, my brother, this is my zakah. May Allah reward you with good and pray for you." He says, "What do you think? I will give you the value of this bag. It is better than you struggling and carrying it." He says, "May Allah reward you with good" again. The poor man does not understand that this is a treasure...
The existence of such fatwas in the depths of the books means that they misunderstood Islam and fell into the same tricks that the Jews fell into before, whether in the story of the prohibition of fishing on the Sabbath and their deception of it by obtaining the catch on Sunday, so they did not miss the day of the Sabbath, or in what he (peace be upon him) said, which is mentioned in the Qur'an.
Or what he (peace and blessings be upon him) said: "May Allah curse the Jews. The fats were forbidden to them, so they rendered them and sold them and ate their price. And when Allah forbids the eating of something, He forbids its price." What did the Jews do? The fats were forbidden to them
And by the wrongdoing of those who were Jews, We have forbidden to them [certain] good things which had been permitted to them. فبظلم من الذين هادوا حرمنا عليهم طيبات أحلت لهم
They used to slaughter the fat, plump animal. Allah, as a test and trial for them, said, "It is forbidden to you. Go, this fat, you must throw it away." In their injustice, they endured this ruling for a period. Then their patience ran out. The group said, and Satan said to them, "My people, why are you wasting money? Take these fats, melt them, and benefit from them. It is better than throwing them away. And in this way, you will not have contradicted the Shari'ah." So they took the fats and put them on the large pots. They lit the fire underneath. They melted it. What did it become? A new form. They thought with this new form. It took a new ruling. The fat is the same in its chemical composition, its taste, its color, its smell, and so on. And we have become today, as he (peace be upon him) said, "You will follow the ways of those before you, span by span and cubit by cubit, until if they entered the hole of a scorpion, you would enter it." They adopt the same tricks.
The marriage of tahil is permissible. The Messenger says, "May Allah curse the one who performs tahil and the one for whom it is performed." My brother, the pillars of marriage and the conditions of marriage are present. The wife agreed, her guardian is satisfied, the witnesses testified, and the suitor is also satisfied. Why is this marriage not valid? Because the Messenger (peace be upon him) said, "May Allah curse the one who performs tahil and the one for whom it is performed." For him, this is a valid marriage... invalidation... I seek refuge in Allah. Cursing is invalidation and more. That is what they say. Invalidation did not invalidate. I wonder, when the Wise Lawgiver comes and says, "May Allah curse the one who performs tahil and the one for whom it is performed," does He mean that he proceeded with this marriage because it is permissible and not invalid, or that he should stay away from it? Stay away. Cursed is the one who does it. How can this be a valid marriage in itself?
And then, putting money in a bag of salt or sugar or rice, what is this? This is if one turns over many concepts in the Shari'ah. And the matter does not stop at this in issues of rulings. It reached Islamic creed. We keep repeating to you, especially the Sufis, who made the Creator and the created one thing. And these ideas are entrenched in the minds of the masses of Muslims. Some are in the open, and some are hidden. As for the Sufis who declare non-existence, "There is nothing in the universe but Allah. There is nothing in the robe but Allah. Whatever you see with your eye is Allah," and so on. As for the hidden, Allah is present in every place. Allah is present in all existence. This is existence. But this is not as explicit as the first. So if Islam has changed in many of its creedal and ruling aspects, if I may express it that way, when the Messenger (peace be upon him) mentioned the sale of 'inah, he mentioned it by way of example, not by way of limitation. So this marriage of tahil is also forbidden, and he cursed its doer. So if you trade with one another through 'inah and do such and such, and make the marriage of tahil permissible.
In addition to that, He mentioned other defects and said, "You took the tails of the cows and were content with the crops," which is a metaphor for their reliance on this world and their preoccupation with it. It is a means, not an end, yet it has become an end due to the poor upbringing of Muslims. So, if we look here at this result, it is because you misunderstood Islam and misapplied it. Among those things is that you abandoned jihad in the path of Allah. I wanted to say, but I held back. I wanted to say, "You abandoned jihad in the path of Allah, which has not been subject to distortion, and Muslims still believe in the obligation of jihad in the path of Allah." I wanted to say this, but then I remembered, unfortunately, an article that appeared in the modern era stating that jihad in the path of Allah is not permissible except in the way of self-defense. Articles were written and published by al-Azhar, and the misguided Qadianis, who are well known, adopt this view and state it explicitly. Their prophet, the Dajjal, says, "It is forbidden for all Muslims to fight the English; rather, jihad is only self-defense." So, even jihad has been subjected to distortion. Our problem is not that we do not jihad now because we are unable to jihad. We are unable to jihad because we are not Muslims. Otherwise, if we were truly Muslims, we would have taken the means of spiritual and material jihad simultaneously, because among the meanings of
And make ready against them all you can of power. وأعدوا لهم ما استطعتم من قوة
Sunan Ibn Majah 2813Sahih (Darussalam)
are spiritual and material aspects. So, if you return and understand Islam correctly and apply Islam, Allah will honor you. But if you persist in the rulings of Islam and abandon acting upon what you still know of the rulings of Islam, what is your punishment? Allah will impose upon you a humiliation that He will not remove from you until you return to your religion. So, my brothers, returning to the religion is not an easy matter. It requires, above all, a correct Islamic culture. Then, it requires that this correct Islamic culture be accompanied by upbringing based on this correct Islam. That is, there must be a group that binds themselves to the correct understanding and correct practice. And until Muslims first return to the first truth, which is that they are convinced with us that it is not enough to say "Islam, Islam, and the Islamic religion, and there is nothing like it, and it is suitable for every time and place." We are among those who understand it as required by the Book and the Sunnah, and a large part of what we understand, we do not apply. I say, for example, instead of jihad, I wanted to say that the concept is still correct, and then I remembered the painful reality.
But I say, praise be to Allah, Muslims still believe that the display of adornment by women is forbidden. But where are those who apply what they know? Most Muslim women today are displaying their adornment, violating the text of the Book and the Sunnah and the consensus of the community. And perhaps among us Salafis, there may be some like these. So, this is an issue that requires knowledge and requires action. When Muslims return to their religion in understanding and action, then Allah will support them and honor them. "Allah will impose upon you a humiliation that He will not remove from you until you return to your religion." So, your religion, in correct understanding and correct action. Please, you wanted to ask... Did you forget your question?
