The Shaykh : The illness of the Muslims today is their turning away from their religion and not following the Shari'ah of their Prophet (peace and blessings be upon him). This turning away is divided into two categories, as the first part of this hadith indicates to us. The first category, or the first type of turning away, is contradicting the clear and evident Shari'ah through twisted means, which some may call legal stratagems. This is what the Messenger of Allah (peace and blessings be upon him) alluded to in his saying:
When you trade with one another using 'inah إذا تبايَعْتُم بالعينة
. The second category of turning away is that they still—praise be to Allah—know the ruling of Allah without any change, alteration, or figurative interpretation; and that is being engrossed in this world and preoccupied with it to the neglect of religion, including jihad in the path of Allah.
He (peace and blessings be upon him) said:
When you trade with one another using 'inah إذا تبايَعْتُم بالعينة
. 'Inah is a type of sale involving deception to consume riba and consume the wealth of people unjustly under the name of sale. The sale of 'inah: 'Inah is derived from 'ayn, meaning the essence or substance of a thing. The form of this sale is that the commodity or need is sold in its place in two ways of sale: sale for cash and sale on installment. The sale for cash is at a lower price, and the sale on installment is at a higher price. This is the sale of 'inah. I do not wish to speak now about installment sales, as we have no room for it now.
The sale of 'inah is when a man comes to a merchant, such as a car dealer, and pretends before him that he wants to buy a certain car, while he knows he has no liquidity and no currency. Rather, he wants to obtain and gain the currency through this deceptive sale. He comes and says to the merchant: How much is this car? The merchant says: For cash, for example, ten thousand, and on installment, ten thousand plus one hundred or two hundred, depending on the case. The buyer pretends that he bought it at the higher price, which is the installment price. Then this buyer on installment, not for cash, quickly becomes the seller, and consequently the seller becomes the buyer. The first buyer, who bought on installment and was recorded as owing ten thousand plus such and such, says to the merchant: Will you buy this car from me for cash? They agree on eight thousand, or seven thousand, as it may be. He receives the value of this car from the merchant who sold it to him. He receives it in cash. He leaves having received seven thousand or eight thousand, while ten thousand or more was recorded against him, as we said earlier. This is the sale of 'inah. This is deception to make permissible the consumption of people's wealth unjustly, and to make permissible the riba for which Allah (Mighty and Majestic) has warned those who consume it that He will wage war against them. Therefore, the Messenger of Allah (peace and blessings be upon him) placed at the beginning of this hadith, among the causes that if Muslims commit them, they deserve to be humiliated by others, the disbelievers. He said:
When you trade with one another using 'inah إذا تبايَعْتُم بالعينة
; meaning: If you consume riba under the name of sale.
