His Eminence the Shaykh: A person who did not perform Hajj as a mutamatti' and did not reach Mecca on the eighth day: should he exit the state of ihram, or should he enter the state of ihram for Hajj after the 'Umrah, or should he remain in the state of ihram for the 'Umrah?
We hold that the tamattu' is severed if the time for Hajj enters, and the time for Hajj is at the morning of the eighth day. So, if one did not reach Mecca until after the people had departed for Mina, we say: Do not come with an 'Umrah, for the time for 'Umrah has ended.

Because Allah says:
whoever performs 'umrah [during the Hajj months] followed by Hajjفَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ
[Surat al-Baqarah: 196] So He made it an 'Umrah and a Hajj, and He set a limit between them, which is a distance,Regarding His saying: (to Hajj) So if he arrives on this day, we tell him now: either enter the state of ihram for Hajj alone, or enter the state of ihram combining 'Umrah and Hajj.
And the morning is before the sun reaches its zenith, because the Prophet (peace and blessings be upon him) led the Muslims out to Mina and prayed the midday prayer there,Meaning: one or two hours before the sun reached its zenith.
And if he finishes the 'Umrah one or two hours before the sun reaches its zenith, it is not obligatory for him to remove his garments,Meaning: there is no harm in him remaining in his ihram garments and making the intention for Hajj.
