Question: If one performs 'Umrah in the months of Hajj, in Dhu al-Qa'dah, then leaves Makkah and goes to Madinah and stays there until the time of Hajj, is tamattu' obligatory, or is the pilgrim free to intend whatever he intends for Hajj? Please inform us, may Allah reward you with good.

Answer: The correct view is that the Muslim remains in the ruling of the one performing tamattu' if he performs 'Umrah in the months of Hajj, then goes to Madinah for visitation, and then comes in the state of ihram for Hajj; in that case, he is considered to be performing tamattu' according to the most likely view, and the sacrificial animal for tamattu' is obligatory upon him. Likewise, if he goes to Ta'if or Jeddah or any other place other than his hometown and then returns in the state of ihram for Hajj, he is considered to be performing tamattu' according to the most likely view. However, if he returns to his family and stays with them, and then comes in the state of ihram for Hajj, he is considered to be performing ifrad for Hajj according to the most likely view, and he is not considered to be performing tamattu' by doing so, and the sacrificial animal is not obligatory upon him if he returns to his family. This is what came from Ibn 'Umar and his father (may Allah be pleased with them both), and it is the opinion of the scholars.
