The Time of the End of the Waiting Period for a Pregnant Woman

Machine translationRead the Arabic original
We are young men from the city of Rafha who came to the Qassim region to visit some of the shaykhs and scholars. So first we say: We love you for the sake of Allah, and we convey to you the greetings of the people of Rafha. They invite you to deliver lectures and religious lessons, because lectures are few among us, O Shaykh. We need some da'is, some scholars, and some shaykhs to visit us in the northern city of Rafha.

And as for my question, O Shaykh: There is a man who passed away and he had three wives. One of the wives was pregnant. When the husband died, she gave birth ten days later. Has her waiting period ended?

First we say: We ask Allah to love you as you have loved us in Him. As for the brothers in Rafha, there is no doubt that they are in need of one who guides them and admonishes them. I think they have enough shaykhs among them. They can ask the head of the court and whoever is a student of knowledge there to sit with them, even if it is only once a week. As for public lectures, I see that a letter should be written to the responsible authorities regarding this matter, and lectures should be arranged with the shaykhs.

And as for the answer to the question: The pregnant woman who gave birth ten days after her husband's death has her waiting period ended. The other two wives remain until four months and ten days have completed for each of them from the husband's death. And whoever is pregnant waits until she delivers her pregnancy. The evidence for that is the saying of Allah the Exalted:
And for those who are pregnant, their term is until they give birthوَأُولاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[Al-Talaq:4],And His saying regarding those who are not pregnant:
And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days]وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجاً يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْراً
[Al-Baqarah:234] And Subay'ah al-Aslamiyyah (may Allah be pleased with her) lost her husband while she was pregnant, so she gave birth a few nights after his death. The Prophet (peace and blessings be upon him) permitted her to marry.
