Your Eminence! You know what women face during Hajj in terms of the crowd and the inability to perform the rites in some places. The scholars have issued a ruling that a woman may stone the pillars at night. Is it permissible for her guardian to go and stone for himself along with her at night, or should he go during the day and only accompany her at night?
The correct view is that stoning at night is permissible, except on the night of the festival, when it is not permissible except at the end of the night. Likewise, on the twelfth day, one should not delay it until night; because if he delays it until night, he would have to remain until the thirteenth day. Similarly, stoning on the thirteenth day should not be delayed until night; because the days of Tashriq end with the sunset of the night of the thirteenth.
It is permissible even for a non-woman to stone at night. We see that stoning at night with tranquility and performing the stoning with humility is better than going to stone during the day when he does not know whether he will return to his tent or die, and he does not perform the worship—when he performs it—as worship, but rather performs it as if his mind is preoccupied with fear for his own life.And we have established a principle indicated by the Shari'ah: Preserving the act of worship itself is more important than preserving its time or place, as long as the time is sufficient.Therefore, the Prophet (peace and blessings be upon him) said: (There is no prayer in the presence of food, nor while one is struggling with the two excretions),So to the one who is struggling with the two excretions, we say to him: Delay the prayer until the end of the time until you relieve yourself. Although the prayer at the beginning of the time is better; but if you pray while struggling with the two excretions, you will not attain the humility that is attached to the act of worship itself.
Therefore, we see in the present time that stoning at night is better than stoning during the day, if stoning during the day does not result in humility and performing the worship in the required manner.
