Questions among the common people regarding Hajj

Machine translationRead the Arabic original
They say: Some say that if a person has missed days of Ramadan to make up and has not fasted, he has no Hajj! This is incorrect, for there is no connection between making up Ramadan and Hajj.

And some of them say: Some say that if the 'aqiqah sacrifice has not been performed for a child, he has no Hajj. This is also incorrect, for there is no connection between Hajj and the 'aqiqah.

And some of them say: If a woman is menstruating and has not performed the tawaf of departure, she puts a pad on her private parts and performs tawaf while menstruating, but this is not valid. If this were permissible, the Messenger of Allah (peace and blessings be upon him) would have said in the hadith of Safiyyah: "Let her use a cloth to protect herself and perform tawaf," just as he said to Asma' bint Umayyad when she gave birth at Dhul-Hulayfah and sent to him asking, "What should I do?" meaning regarding the state of ihram. He said: (Take a bath, use a cloth to protect yourself, and enter the state of ihram) But what do we do if a woman is menstruating and has not performed the Tawaf of Ifadah, and her family is about to travel? What should she do?We say: If she is in the Kingdom of Saudi Arabia, her matter is easy. She has two options: either she and her mahram remain in Makkah until she becomes pure and performs Tawaf. This is easy, praise be to Allah; she and her mahram can remain, and once she is pure and has performed Tawaf, they can travel by any means—by plane, by public transport, by private car, or by any other means—because it is easy in the Kingdom.
Or she can travel to her place of work and remain in the state of the second release (tahallul), because she has only performed the first release. Therefore, it is not permissible for her husband to enjoy her or to contract a new marriage with her. When she becomes pure, she returns to Makkah and performs the Tawaf of Ifadah. However, in this case, she should enter the state of ihram for 'Umrah from the miqat, perform Tawaf and Sa'y, and shorten her hair for the 'Umrah, and then perform the Tawaf of Ifadah. This is if she is in the Kingdom of Saudi Arabia.

And if she is abroad, then here we choose what Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) chose: that she should protect herself—by placing something on her private parts to prevent blood from leaking into the mosque—and perform Tawaf even if she is menstruating; this is due to dire necessity, for one who is not in the Kingdom finds it difficult to return and finds it difficult to remain with her mahram, falling behind the group. And Allah, Blessed and Exalted is He, said:
while He has explained in detail to you what He has forbidden you, excepting that to which you are compelledوَقَدْ فَصَّلَ لَكُمْ مَا حَرَّمَ عَلَيْكُمْ إِلَّا مَا اضْطُرِرْتُمْ إِلَيْهِ
[Al-An'am: 119] Necessities permit what is prohibited. So if the Tawaf of a menstruating woman is forbidden and she is compelled to do it, she does what is feared to lead to the prohibited act, which is to protect herself—placing a cloth on her private parts to prevent blood from leaking into the mosque—and perform Tawaf.
Perhaps what we have said now is sufficient, and success is from Allah.
