The Shaykh : Here are matters among the common people
They say: If a person has missed days of Ramadan to make up and has not fasted, then he has no Hajj! This is incorrect; there is no connection between making up Ramadan and Hajj.
Some of them also say: If the 'aqiqah sacrifice has not been performed for him, then he has no Hajj. This is also incorrect, because there is no connection between Hajj and the 'aqiqah.
Some of them also say: If a woman is menstruating and has not performed the Tawaf of Ifadah, she should wear a pad on her private parts and perform Tawaf while menstruating. This is not authentic. If this were permissible, the Messenger (peace and blessings be upon him) would have said in the hadith of Safiyyah: "Let her wrap a cloth around herself and perform Tawaf," just as he said to Asma' bint Umays when she gave birth at Dhul-Hulayfah and sent to him asking: "What should I do?" meaning regarding the state of ihram? He said:
Take a bath, bandage your private parts and put on Ihram اغتسلي واستثفري بثوب وأحرمي

But what do we do if a woman is menstruating and has not performed the Tawaf of Ifadah, and her family is going to travel? What should she do? We say: If she is in the lands of Saudi Arabia, her matter is easy. She has two options: either she and her mahram remain in Makkah until she becomes pure and performs Tawaf. This is easy, praise be to Allah. She and her mahram can remain, and when she becomes pure and performs Tawaf, they can travel by any means: by plane, by public transport, by private car, by any means, because it is easy in the Kingdom.
Or she can travel to her place of work and remain in the state of the second tahallul, because she has only performed the first tahallul. Therefore, it is not permissible for her husband to have sexual relations with her or to contract a new marriage with her. When she becomes pure, she returns to Makkah and performs the Tawaf of Ifadah. However, in this case, she should enter ihram for 'Umrah from the miqat, perform Tawaf and Sa'y, and shorten her hair for the 'Umrah, and then perform the Tawaf of Ifadah. This is if she is in the lands of Saudi Arabia.
If she is outside, then here we choose what the Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) chose: that she should use a tampon, meaning she should take precautions, placing something on her private parts to prevent blood from leaking into the mosque, and she should perform Tawaf even if she is menstruating. This is due to dire necessity, because for one who is not in the Kingdom, it is difficult for her to return, and it is difficult for her to remain with her mahram, falling behind the group. And Allah (Blessed and Exalted is He) said:
while He has explained in detail to you what He has forbidden you, excepting that to which you are compelled وَقَدْ فَصَّلَ لَكُمْ مَا حَرَّمَ عَلَيْكُمْ إِلَّا مَا اضْطُرِرْتُمْ إِلَيْهِ
[Al-An'am 6:119]
So dire necessity permits what is prohibited. If the Tawaf of a menstruating woman is forbidden and she is compelled to do it, then she does what is feared to lead to the prohibited act, which is to take precautions by placing a cloth on her private parts to prevent blood from leaking into the mosque, and she performs Tawaf.
