Islam: And its opposite is disbelief, and Islam is a condition for all acts of worship,And the meaning of the condition of Islam: that it is not obligatory upon the disbeliever, and even if he performed Hajj, it would not be valid from him;Because among the conditions for the validity of acts of worship: Islam,And the meaning of our saying: that it is not obligatory upon the disbeliever, that if he embraced Islam after being wealthy during his state of disbelief, then became poor and embraced Islam after that, Hajj is not obligatory upon him; because when he had the ability, he was not among those for whom it is obligatory—he was not a Muslim—so Hajj is not obligatory upon him, except that he will be punished for it on the Day of Resurrection; because the disbeliever, according to the stronger opinion, is addressed with the branches of Islam,Meaning: that he sins by neglecting them, but he is not obligated to make them up if they became obligatory during his state of disbelief;because of the saying of Allah the Exalted:
Say to those who have disbelieved [that] if they cease, what has previously occurred will be forgiven for themقُلْ لِلَّذِينَ كَفَرُوا إِنْ يَنْتَهُوا يُغْفَرْ لَهُمْ مَا قَدْ سَلَفَ
[Al-Anfal: 38] .
