In the hadith, it is stated: “The Prophet (peace and blessings be upon him) forbade a woman to take a ritual bath with the man’s leftover water, or a man to take a ritual bath with the woman’s leftover water; rather, they should scoop water together”. And the second hadith states: “The Prophet (peace and blessings be upon him) used to take a ritual bath with Maimunah’s leftover water”. How are these two reconciled?
The first is a prohibitive guidance, meaning it is recommended that a man not take a ritual bath separately from his wife while she is taking a ritual bath. It is better for them to take a ritual bath together in one vessel and in one place. This is the meaning of the hadith. It is not a prohibition of harm, nor even a prohibition of dislike, but rather a prohibitive guidance instead of you taking a ritual bath in one vessel and your wife in another. They should gather together, and this is the way of the Prophet (peace and blessings be upon him). He and Aisha used to take a ritual bath from one vessel, and their hands would differ in it,Until you say: saying, “Leave it for me! Leave it for me!” This is also what strengthens the love and bond between the two spouses.
As for the Prophet (peace and blessings be upon him) taking a ritual bath with Maimunah’s leftover water, it was because she had preceded him, and the time of her ritual bath did not coincide with the time of his. So he took a ritual bath after her. Based on this, the weakness of the position held by jurists that a man does not take a ritual bath with what a woman has used for an obligatory ritual purity becomes clear. Rather, we say he takes a ritual bath and there is no blame on him.
