What is the ruling on one who went for Hajj and, before Hajj, on the fifth of Dhu al-Hijjah, exited the state of ihram after descending to Makkah?

Machine translationRead the Arabic original
The questioner: Oh Shaykh, if you please, the Sunnah... his children... they are not adults, one is eleven years old and one is thirteen, and he took them on the fifth of Dhu al-Hijjah. He seated them in Mina and said to them, "Sit here in ihram, do not go right or left until I come to you," and I returned to...
The student : They were performing ifrad.

The questioner: as ifrad (individual Hajj), and I was in... they descended to Makkah, they removed their ihram garments, they performed tawaf and sa'y, they removed their ihram garments, and they shortened their hair.
The student : The question.

The questioner: Do they have anything upon them, a hady (sacrificial animal)?

The Shaykh: Like this, now we need to work.
The student: ... hehe.

The Shaykh: Hehe, I am thinking, I did not understand the question... the news came, do they have anything upon them? Well, I really did not clarify for me whether there is an error, so I asked about them, something or nothing? What is the error you are assuming?

The questioner: They have no error upon them, they have a hady (sacrificial animal) upon them now, meaning these ones.

The Shaykh: You are saying you performed Hajj as ifrad (individual).

The questioner: Yes.

The Shaykh: Well, the hady (sacrificial animal) is for the mutamatti' (one combining Umrah and Hajj) or the qarin (one combining Umrah and Hajj in one ihram).

The questioner: They did not remove their ihram, they took an Umrah, they performed tawaf, they removed their ihram, they exited the state of ihram.
The student : They did the Sunnah.

The Shaykh: When was the exit from ihram, my brother?

The questioner: The exit from ihram was on the seventh day.

The Shaykh : Hmm.
The student: From the fifth day, from the day he left them, they descended to Makkah, they performed tawaf and sa'y, they shortened their hair, and they returned to their tent.

The Shaykh: You did not mention when the exit from ihram was.
The student: Yes ... .
Another student: He wants to keep completing for him...

The Shaykh: Well, you are writing these questions.

The questioner: No, this one, and we are in Hajj, they wanted to ask, and we know the issue.

The Shaykh: I mean, it should be that the question is complete so that I can comprehend it.

The questioner: Yes.

The Shaykh: and it becomes easy for me to answer it. So now, these ones, meaning they performed Umrah, even though they had intended Hajj ifrad (individual) like this.

The questioner: Yes.

The Shaykh: up to here.
The student: Peace be upon you.

The Shaykh: And upon you be peace and the mercy of Allah and His blessings. After they performed the Umrah, they exited the state of ihram naturally, then what happened after that?

The questioner : They sat in Mina.

The Shaykh : Hmm.

The questioner : They sat in Mina.

The Shaykh: Yes, and they completed the Hajj.

The questioner: Yes.

The Shaykh: And they performed tawaf al-ifadah (the farewell tawaf).

The questioner: On the eighth day, they entered the state of ihram, and everything was fine.

The Shaykh: My brother, the word "and" covered it, may Allah guide you, he performed tawaf al-ifadah (the farewell tawaf).

The questioner: Yes.

The Shaykh: Yes.

The questioner : They performed the complete Hajj.

The Shaykh: Good, and what did their father do?

The questioner : ... .

The Shaykh: He, regarding his Hajj, what did he do?

The questioner : I did.

The Shaykh: Nor I.

The questioner: I performed Hajj ifrad (individual).

The Shaykh: You, my brother, what did you do?

The questioner : I performed Hajj ifrad.

The Shaykh: Well, the children's Hajj is better than their father's Hajj. They really, without any prior fiqh (jurisprudence), brought the Sunnah, whereas their father opposed the Sunnah, indeed he opposed the obligatory, because the sons annulled their Hajj to an Umrah, and that is what the Messenger (peace be upon him) ordered in the Farewell Pilgrimage in two stages or in two different times. Completely, it is established in the authentic hadiths that when the Prophet (peace and blessings be upon him) performed the Farewell Pilgrimage and thousands of his Companions performed it with him, they were of three types: among them were those doing ifrad (individual Hajj), among them were those doing tamattu' (combining Umrah and Hajj), and among them were those doing qiran (combining Umrah and Hajj in one ihram). And these qarin (those combining) divided into two sections regarding their actual situation: among them were those who brought the hady (sacrificial animal) from Dhu al-Hulayfah, and among them were those who did not bring the hady (sacrificial animal). And with this last division, the types of pilgrims with the Messenger became four: ifrad (individual), qarin who brought the hady (sacrificial animal), qarin who did not bring the hady (sacrificial animal), and mutamatti' (combining Umrah and Hajj). Four types. And they continued to chant the talbiyah for their Hajj, all of them, until they descended to a station from those stations. The Messenger (peace be upon him) preached to them and taught them some of the rituals of Hajj, and he said to them, among other things:
Whoever among you did not bring the hady (sacrificial animal) and loves to make it an Umrah, let him do so مَن كان منكم لم يسُقِ الهدي وأحبَّ أن يجعَلَها عمرة فليفعَلْ
, and I ask you to pay attention now to his saying (peace and blessings be upon him) that he specifically mentioned those who did not bring the hady (sacrificial animal) first, then he said:
and loves to make it an Umrah, let him do so وأحبَّ أن يجعلها عمرة فليفعَلْ
Sahih Ibn Hibban 15:108
, so he returned the exit from ihram via Umrah from Hajj or from qiran (combining) that is not with a hady (sacrificial animal) to the desire of the person obligated, and they proceeded with that until they reached Makkah. And there, before entering Makkah, there is no need, my brother, there is no need, may Allah bless you. There, before entering Makkah, he preached to them the same sermon, but he did not say "whoever loves to make it an Umrah, let him do so," but rather he said:
Whoever among you did not bring the hady (sacrificial animal), let him make it an Umrah مَن كان منكم لم يسُقِ الهدي فليجعَلْها عمرة
,
Let him make it an 'Umrah فليجعَلْها عمرة
, so the Messenger (peace be upon him) gradually moved the people from Hajj ifrad (individual) to tamattu' (combining) at first with choice, so as not to surprise them with what was not in their calculation. And it was as it is established in some of the authentic hadiths that among the most disliked things with them was for the one performing Umrah to do so in the months of Hajj, so the Messenger (peace be upon him) invalidated this custom with some of the authentic hadiths, and this portion is in our hands now, as we mentioned. So before entering the Sacred Mosque, he said to them:
So whoever among you has not brought sacrificial animals, let him make it an 'Umrah فمَن كان منكم لم يسُقِ الهديَ فليجعَلْها عمرة
. Despite all this, when the Messenger (peace and blessings be upon him) performed tawaf and sa'y and exited the state of ihram, he did not exit the state of ihram because he was qarin (combining); likewise did those who had intended qiran (combining) and did not exit the state of ihram. So when the Messenger (peace be upon him) saw them, the matter was difficult for him, so he said to them
O people, exit the state of ihram. If it were not that I have brought sacrificial animals, I would have exited the state of ihram with you يا أيها الناس ، أحلُّوا ، فلولا أني سُقْتُ الهديَ لَأحلَلْتُ معكم
. Jabir, the narrator of the hadith, said: "The incense burners were lit and we exited the state of ihram, and we came to the women." Therefore, the blessed children did a good deed and responded to the command of the Messenger (peace be upon him). And thus it is obligatory upon every pilgrim, whether he intended Hajj ifrad (individual) or intended Hajj qarin (combining) and did not bring the hady (sacrificial animal) from the state of ihram (hal), and this is the majority of what is upon most pilgrims today. It is very, very rare for one to bring the hady (sacrificial animal) from the state of ihram (hal) except some Bedouins or some Arabs, and this is known about them. But people like us, we Jordanians and Syrians, let alone those who are farther away.

The questioner: by airplanes.

The Shaykh: Ah, so they do not bring the hady (sacrificial animal) for that. These people must perform the Umrah before the Hajj and exit the state of ihram, then on the eighth day they chant the talbiyah for Hajj where their station was, and upon them after that is the hady (sacrificial animal). Perhaps you sacrificed on behalf of your sons.

The questioner : Yes.

The Shaykh : This is a problem.

The questioner: This is my question.

The Shaykh: This was not the question, but I answered without a question, hehe.

The questioner: ... they fasted.

The Shaykh: Nor did they fast, this is not by direction.
The student: This is the fitrah (innate natural disposition).

The Shaykh: And upon you be peace and the mercy of Allah and His blessings. It needs a little thinking. And upon you be peace and the mercy of Allah and His blessings. Complete it, Doctor, complete it, yes...
