The questioner : He says:The questioner : My esteemed Shaykh, I did not come to this country except for the sake of Hajj, and I fear that the one I work for will not approve of my performing this obligatory duty. I am currently in Saudi Arabia, a short distance from the rites of Hajj. I hope that Allah will guide my guarantor and that he will agree to my performing Hajj. But if he does not agree to my performing Hajj, does my intention count as having fulfilled the obligation or not? Because the Prophet (peace and blessings be upon him) said:
The reward of deeds depends upon the intentions and every person will get the reward according to what he has intended. إنما الأعمال بالنيات وإنما لكل امرئ ما نوى
Sahih al-Bukhari 1
And is this considered a form of ability? I ask for clarification and for our brother guarantors to be encouraged to enable those working under them to perform Hajj at the Sacred House of Allah.

The Shaykh : We hope that Allah (Mighty and Majestic) will guide all our brother guarantors and that they will permit their brothers who work for them to perform the obligatory Hajj, because this falls under the category of cooperating in righteousness and piety, and Allah has commanded that, saying the Exalted:
cooperate in righteousness and piety وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى
[Al-Ma'idah 5:2]
And because this may be a cause of blessing in their work and their sustenance, for example, if work stops during these ten days, Allah may send down blessing in the remaining work, and they will obtain much good. If this is facilitated, that is what is desired and what we hope for from our brother guarantors. If it is not facilitated, then he is not considered able, and Hajj is dropped from him, because Allah the Exalted said:
for whoever is able to find thereto a way مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلاً
[Ali 'Imran 3:97]
and he was not able.
As for the questioner’s statement that he would be like one who has performed Hajj: no, but Hajj is dropped from him until he is able. Even if he dies before he is able to perform Hajj, he dies not in sin against Allah, because Hajj is not obligatory except with ability. Yes.
