The questioner : The listener, Kheiriyyah M.M. from Hail, says: I have gold that I use only for adornment, and I have heard conflicting opinions regarding the zakah of gold intended for use. Some affirm the obligation of zakah on it, while others exempt it from zakah. What is the correct opinion in your view? May you be rewarded?

The Shaykh : The correct opinion is that gold and silver jewelry is subject to obligatory zakah, due to the generality of the evidence indicating the obligation of zakah in gold and silver without distinction, and because there are specific hadiths indicating the obligation of zakah in used jewelry. However, zakah is not obligatory until it reaches the nisab, which is eighty-five grams for gold and five hundred and ninety-five grams for silver. Anything less than that is not subject to zakah. If a man has daughters and each of them has jewelry that does not reach the nisab, then if this father gave them the jewelry as a gift of ownership, there is no zakah on him or on them regarding the jewelry they possess, because what each of them possesses does not reach the nisab. But if he gave it to them as a loan for use, the jewelry is his property, and he must combine some of it with the rest and pay its zakah when it reaches the nisab.
