I bought goods from a person for two hundred dinars, then sold them. After three days, I saw the seller, and he asked me to return the goods to him because he had made a mistake with me regarding the price.

The questioner : I bought goods from a specific person.

The Shaykh: Yes.

The questioner : So we agreed on a specific price. I took the goods and dealt with them for the purpose of, meaning, selling them and profiting from them. After three or four days had passed, I reviewed the matter with the person or visited him, and he told me, "Excuse me, there was a mistake in the price of the goods. Its value was approximately two hundred dinars. He told me, 'We made a mistake with you by one hundred dinars,' meaning there was a mistake between one type of goods and another. Before he said this to me, he asked, 'What do you think about returning the goods, if you have not dealt with them yet?' I said, 'No, by Allah, I have dealt with them; I sold some and dealt with some.' He presented this reality to me. So, of course, he says 'may Allah reward you with good,' and I say 'may Allah reward you with good,' meaning, it is the decree of Allah (Mighty and Majestic). But now, as for the Islamic ruling for me and for him in this case, he is, of course, undeniably harmed, because when they wanted to sell, they sold for three hundred instead of two hundred. And I am harmed at the same time, because I calculated my sale of the goods based on the price I received. For example, the price of the piece is one dinar; why did I sell it for one dinar? Because I bought it for two hundred dinars, so I divided the number of pieces I had, and so on. So I do not know, my Shaykh, what is your guidance?

The Shaykh : All right, did the mistake, his mistake, become apparent to you?
The student : It became apparent from his words, but, meaning, I have no appearance of it beyond that. I do not know what the original value of the goods is; he is, meaning, its owner.

The Shaykh : Are the goods uniform, one type, or are there different types?
The student : One type.

The Shaykh : One type.
The student: Yes.

The Shaykh : Ah, given that the goods are of one type, he is saying it is one type, and he is saying that he gave you a price that differs from the price at which he sells it.
The student : Yes, of course, my Shaykh, here, from the standpoint of, meaning, clarity, perhaps a confusion arose. Let us say that this mistake is that these goods have categories: a first category, a second category, a third category. So when he told me, meaning, 'Take these goods,' he thought they were the second category, and then it became clear to him that they were the first category. So here the mistake arose, in order to, meaning, clarify the matter.
