The questioner : A man bought goods from a merchant for thirty dinars. The sale was completed and they parted ways. On the second day, the man came to return the goods because he did not need them and he needed the money; he did not want them. This merchant conditioned that he return them to him on the condition that he deduct ten dinars. What is your opinion on that?

The Shaykh : He conditioned on him, meaning he bought from him, and what else?

The questioner : I mean, yes, I bought from him.

The Shaykh : No, no, but just a word and it covered it up, he bought from him?

The questioner : Yes, he bought from him.

The Shaykh : I mean, let me give you an example. He bought them for fifty dinars, and he said to him, I will buy them from you for forty dinars. This is a sale and a purchase, and of course it is permissible.

The questioner : The word "return" means no... here.

The Shaykh : Your question was very clear. The offer and acceptance took place, he took the goods, and the man took the price and left. Then he regretted it. Here we have a fatwa and we have taqwa. I have not heard the fatwa. Taqwa is his saying (peace be upon him):
Whoever releases a regretful person from his mistake, Allah will release him from his mistake on the Day of Resurrection من أقال نادما عثرته أقال الله عثرته يوم القيامة
Taqwa is that he says to him, "Here are the fifty dinars, they are yours, and what is with Allah is better and more lasting." This is taqwa. But if he says to him, "I sold it to you with your consent," and so on, and you want me to buy the goods from you; I sold it to you for fifty, I will buy it from you for forty. It becomes a new sale and purchase, there is no obstacle, and it is permissible. But the best is to release him from the contract as long as he is regretful of the purchase.
