The questioner : May Allah reward the honorableThe Shaykh : A man buys cars for trade from the owner of a car dealership, pays their value, receives the keys, and parks them next to the dealership for sale, but he cannot remove them from the dealership until ownership is transferred to the person who bought them. He says, "I park them in the dealership, and when someone comes to buy them, I sell them to him, whether for cash or on credit, and the buyer transfers ownership to himself." It is known that the buyer usually sells the car to the dealership owner or to someone else, and the car has not moved from its place. What is the ruling on this transaction: is it lawful or forbidden? If it is forbidden, how should one who has engaged in it act? And does paying the value and receiving the keys count as taking possession of the goods? Please advise us, may Allah reward you.

The Shaykh : The safest course for the man who engages in this transaction is to have a yard, meaning a spacious enclosed area. When he buys the cars from the dealership, he moves them to his yard, and then sells them from that place, i.e., the place he prepared himself. As for selling them while they are still in the dealership, the Prophet (peace and blessings be upon him) said:
forbade to sell the goods where they are bought until the tradesmen take them to their houses نهى أن تباع السلع حيث تبتاع حتى يحوزها التجار إلي رحالهم
Sunan Abi Dawud 3499Hasan li ghairih (Al-Albani)
The hadith here is explicit. As for what the questioner did before he knew, Allah said in His Book:
So whoever has received an admonition from his Lord and desists may have what is past, and his affair rests with Allah فَمَنْ جَاءَهُ مَوْعِظَةٌ مِنْ رَبِّهِ فَانْتَهَى فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّهِ
[Al-Baqarah 2:275]
So when he stops what he was doing, he is forgiven for what came before, because Allah the Exalted is more merciful to His servants than a mother is to her child.
