What Emerges from the Earth

Machine translationRead the Arabic original
The Shaykh : We have remaining with us the topic of what emerges from the earth. What emerges from the earth in the form of grains and fruits is subject to zakah. What is its measure?
It is half of one-tenth if it is watered by irrigation using effort, and the full one-tenth if it is watered without effort, whether it draws water through its roots, is watered by rivers, or is watered by rain. In these cases, the full one-tenth is due. If it is watered with effort, then half of one-tenth is due.
It is obligatory for a person to count all that he has obtained and pay its zakah. In our time, the government here in Saudi Arabia used to take the crops and deduct the zakah from their value. In this case, the zakah is sufficient, because the government takes it, and the zakah that reaches the government has reached its destination.
But many people ask about a portion of the crop that he stores to be seed for the coming year. Is there zakah on it?
The answer is: Yes, there is zakah on it, based on the saying of the Prophet (peace and blessings be upon him):
For what is watered by the heavens and steams, the Ushr is due, and for what is watered by irrigation, half of the Ushr. فيما سقت السماء العشر، وفيما سقي بالنضح نصف العشر
Jami` at-Tirmidhi 639Hasan (Darussalam)
This includes what emerges, all of the crop. So what a person stores to be seed, he must pay zakah from it, because the Prophet (peace and blessings be upon him) made zakah a common share in the produce, so he must pay zakah from all of it.
