'Abd al-Malik: And we ask you to explain it: that the Messenger of Allah (peace and blessings be upon him) set the miqat of Dhu al-Hulayfah for the people of Madinah, al-Juhfah for the people of Sham, Qarn al-Manazil for the people of Najd, and Yalamlam for the people of Yemen, and he said
and these Mawaqit are for the people at those very places, and besides them for those who come thorough those places with the intention of performing Hajj and `Umra; and whoever is living within these boundaries can assume lhram from the place he starts, and the people of Mecca can assume Ihram from Mecca. هنّ لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة ومن كان دون ذلك فمن حيث أنشأ حتى أهل مكة من مكة

The Shaykh: It is so, because the hadith in its beginning conditions it for one who comes to them, meaning one who passes by them. And this is what we said earlier: this ruling mentioned by the brother is specific to one who comes from some distant place and passes by the miqat, so it is not permissible for him except to enter the state of ihram from his miqat. But if he enters by a lawful way and then resides there as a pilgrim performing Hajj or 'Umrah, and then he decides to enter the state of ihram, he does so from where he is, if he is a resident. But if he is a traveler, it is as stated in the hadith of the Lady 'A'ishah (may Allah be pleased with her).
