The questioner : These are cases that have occurred, but we want to know the ruling of the Shari'ah in them. For example, a man whose nationality is Moroccan or Egyptian committed zina with a Dutch woman or with one of his own kind, meaning perhaps an Arab woman there. After it became clear that she was pregnant, he wants to marry her and contract the marriage. What is the ruling of Islam regarding this child? Is it attributed to him or not?

The Shaykh : It is not attributed to him. This is a child of zina; it is not attributed to him. And it is not permissible for him to marry her either, because the one who commits zina does not marry except a woman who commits zina or a polytheist, and the reverse is the reverse.
In a rare case, and Allah knows best, whether this is genuine or just a facade: if the two repent with sincere repentance and turn back to Allah (Mighty and Majestic), and truly one of them wants to marry the other not to justify the effect of the previous zina, which is the child—no—but rather as a man marries any woman to protect himself. However, if the intention is to cover up the sin they committed and to register the child of zina under their names, then this is more severe than zina. The answer is clear.
