The questioner : I worked as an accountant in one of the companies for several years, and the founder of this company had been struck by an illness that prevented him from working and caused his mind to become confused, and he did not have the ability to think or distinguish, so he appointed one of the heirs as his agent for all his affairs. This agent would order the payment of salaries, rewards, gifts, and charities, among other things. He said: Also, I committed negligence in performing the work out of ignorance and forgetfulness, and I thought that the agent takes the place of the owner in commanding and forbidding. After the death of the owner of the institution, I sought absolution from the legal agent, and he absolved me of every mistake and negligence, but there is still something of sadness and pain in my heart regarding the great negligence that occurred on my part. So, am I required to seek absolution from all the heirs? And what should I do to be free of liability?

The Shaykh : If you committed negligence intentionally, then you must seek absolution from the heirs of the one you were appointed as agent for, because you are not excused for that. But if what happened on your part was a mistake, and at the time of your action you thought you were correct and that you were in the right, then there is no liability on you, and you are not required to seek absolution from the heirs. So, look into your case: if the matter is as you said first, meaning that you committed negligence that you knew was negligence but you were negligent in it, then you must seek their absolution. And if the matter is otherwise, and you performed the work while believing it to be a compliant and beneficial action, then there is nothing on you.
