The Shaykh : I mean, if he intends by this situation what is apparent from the question—that the owner of the house is demanding the house back from this tenant, and the tenant is unable to comply—then he should perform Hajj. We say: No, return the house, or... his land, if you are unable to return the house as you say. However, there is a wide scope for discussion in this statement, because many people today say, "I am unable to do it," but in reality, upon scrutiny and discussion, they find that they are able to do it. For example, he is able to rent a house, and he is wealthy, but he is not waiting for the house that is... it, and this may also be an unlawful construction, as the question itself suggests, because these housing associations are not established on the basis of Sharia rulings; they involve dealings with riba (usury or interest) and the like.
