The third question of Fatwa No. ( 20399 )
Q3: I have not performed Hajj because I was not financially able to; I do not have sufficient funds to perform Hajj, and I want to perform 'Umrah because 'Umrah does not cost much money. Is it permissible for me to perform 'Umrah before fulfilling the obligation of Hajj? And I have told you
the obstacle preventing Hajj?

A3 : If the matter is as mentioned in the question, then Hajj is not obligatory upon you due to the lack of financial ability. And if you are able to perform 'Umrah, then it is obligatory upon you to perform 'Umrah; because of the saying of Allah (Mighty and Majestic):
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
, and His saying (Glorified and Exalted is He):
And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a wayوَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلا
[Ali 'Imran 3:97]
. And when the ability to perform Hajj becomes easy for you, you will perform Hajj. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
