What is the ruling on staying overnight on the eighth day in Mina? Is it obligatory?

Machine translationRead the Arabic original
The questioner : I, O Shaykh, stood at 'Arafah and I was working as one of the guides for the pilgrims. We did not stay overnight in Muzdalifah, nor in Mina. We stayed overnight at 'Arafah on the night of 'Arafah because we are workers, and of course, I intended to perform Hajj. So, is it obligatory for me to pray in Muzdalifah and return to 'Arafah, given that I am one of the workers?

The Shaykh : Why do you want to return to 'Arafah?

The questioner : I am a worker in 'Arafah.

The Shaykh : What do you mean by workers in 'Arafah?

The questioner : I mean we work as guides for the pilgrims in 'Arafah, ten days before 'Arafah...

The Shaykh : Never mind, but the pilgrims have already left and exited 'Arafah. What is your business in returning after you pray Fajr in Muzdalifah? What do you want to return to 'Arafah for? No one is left there.

The questioner : Before the entry, actually, they are still...

The Shaykh : But he said he wants to pray in Muzdalifah.

The questioner : I mean before 'Arafah, that he sleeps there on the night of Mina.

The Shaykh : I understood, my brother, and he said it, but he finally said that he prayed Fajr in Muzdalifah. So, as they say about us in Syria, we are "children of the hour." Repeat your question.

The questioner : I am saying before the entry, it is obligatory to stay overnight in Muzdalifah before 'Arafah.

The Shaykh : No, not in Muzdalifah. You made a mistake; it is in Mina. On the eighth day, my brother, which is the Day of Tarwiyah, the people will be in Makkah or outside Makkah, and so on, and they will set out for Mina so that on the night of 'Arafah they stay in Mina. Most of the pilgrims will be taken directly by those called "mutoffin" (pilgrim guides) from the Sacred Mosque to 'Arafah, so they will be deprived of staying overnight in Mina, not in Muzdalifah. This, of course, involves a deficiency in leaving an obligatory act. The one who does this intentionally is sinful, and the one who does it out of ignorance, or is overwhelmed by circumstances as you are going around this issue, this,
Our Lord, do not impose blame upon us if we have forgotten or erred. رَبَّنَا لا تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا
[Al-Baqarah 2:286]
.

The questioner : But he has to offer a sacrificial animal.

The Shaykh : Do not expand too much on the obligation of blood sacrifices. There are no blood sacrifices except in three or four places only in Islam. So, you are saying that you missed staying overnight in Mina on the night of 'Arafah because you went to work there. Yes, the blood of Tamattu', and the blood for shaving the head
And whoever among you is ill or has an ailment of the head [making shaving necessary must offer] a ransom of fasting [three days] or charity or sacrifice
[Al-Baqarah 2:196]
, and then there is a third blood. Yes, yes, how? It is the blood of Tamattu', and the blood for shaving the head
And whoever among you is ill or has an ailment of the head [making shaving necessary must offer] a ransom of fasting [three days] or charity or sacrifice
[Al-Baqarah 2:196]
, and then there is a third blood. Hunting, yes, how?

The questioner : One who hunted by mistake.

The Shaykh : Yes, exactly.
And upon you be peace and Allah's mercy and blessings.
