Is he required to hand himself over to the Shari'ah court so that the hudud punishment he deserves is carried out? The answer is no, it is not obligatory for him to do so, although it is permissible. And we must distinguish between "it is not obligatory" and "it is permissible." This is indicated by a collection of texts, some of which are the guidance of the Messenger (peace and blessings be upon him) to anyone who commits or commits a sin to cover it up and not speak about it, even in the way of establishing the hudud punishment against him. I think you all know the story of Ma'iz (may Allah be pleased with him) and how he came confessing to committing zina, and how he asked the Prophet (peace and blessings be upon him) to purify him by establishing the hudud punishment against him. So the first time, he came from the right side, and the Messenger (peace and blessings be upon him) turned him away... Applying the previous rule: "Cover yourself." Hide your face from us. He insisted once here, once here, and once here. Then he (peace and blessings be upon him) said to some of his Companions:
Sniff him استنكهوه
meaning, look at the taste of his mouth, perhaps the man is drunk, rambling, babbling about what he does not know,
Sniff him استنكهوه
there is nothing, the man is normal,
Perhaps you did such and such, like the smell of the date palm, like the bucket in the well, to the end of it لعلك فعلت كذا وكذا ، مثل المين في المرود ، مثل الدلو في البئر إلى آخره

I want to say regarding the wrongdoer, if he does not imagine his ability to stand firm on sincere repentance, in this case it is recommended for him to expose himself to the hudud. But if he, after Allah the Exalted, knows what is in his heart, if he is determined to repent and return to his Lord with sincere repentance, then he has absolutely no need to expose himself to the Shari'ah court.
