The Shaykh : Whether he was a small child or an adult, there is no difference. The important thing is that the killer cannot be said to have killed by mistake, unlike if he had been speeding at a reckless speed on a proper road, especially in crosswalks where limits are placed and the driver must stop there. If he did not stop in that case, then he is responsible. But within the scope of the situation you described, the driver is not required to bear the penalty for accidental killing.
