The questioner : A brother says: I missed the 'Asr prayer, and the time for Maghrib has entered; which one should I pray? I mean: he entered the mosque and the Maghrib prayer is being performed.

The Shaykh : If he missed the 'Asr prayer due to one of the two legitimate legal excuses, namely sleep or forgetfulness, he should begin with the 'Asr prayer before the Maghrib prayer. However, if he missed the 'Asr prayer without these two excuses, there is no room for him to pray it, neither before Maghrib nor after it.

The questioner : I mean, is it supposed to be, Shaykh, that he prays Maghrib with the intention of 'Asr?

The Shaykh : Yes, I have already answered you. May Allah reward you.

The questioner : Yes, yes.

The Shaykh : He prays it before the Maghrib prayer. When we say he prays it before the Maghrib prayer, it is clear that he is praying 'Asr, but on the condition that he forgot it or slept through it. As for if he was preoccupied with his trade, his merchandise, his play, and his games, and so on, then he has missed the prayer, and there is no room for repeating it, whether before Maghrib or after Maghrib.

The questioner : If, Your Eminence,The Shaykh : The weather here, as you know, is cold, so some scholars say: one should combine. Is combining permissible in this situation?

The Shaykh : If the cold is severe and people find it difficult to attend the mosque for the following prayer, it is permissible to combine in order to remove the hardship from the community.

The questioner : But our mosque imam contradicts all the praying people and does not combine, even in previous years when there was very heavy rain, and he would not combine. The praying people leave the mosque, and each person goes to his house or to another mosque, but the imam does not follow the opinion of anyone.

The Shaykh : Fine: if one person wants to combine, he prays in another mosque.

The questioner : I mean, do we leave this imam?

The Shaykh : Yes, exactly.
