When is the takbir performed on the days of the festival, and is it a religious innovation to restrict the takbir to only after every prayer, excluding the rest of the times?

Machine translationRead the Arabic original
The questioner : Regarding the takbir for the festival prayer, in my view, there is no takbir in the mosque even after the prayer! I have prohibited the takbir to prevent them from taking the takbir with one another. I know that there are narrations (athar) that it is permissible to take the takbir on the two festivals, but I prohibit this takbir and tell them to apply the Sunnah in their arrival, meaning outside the mosque.

The Shaykh : What I know is that the takbir on the two festivals differs, one from the other. The takbir on 'Id al-Fitr ends with the prayer, whereas the takbir on 'Id al-Adha is for all four days of the festival. Then, this takbir is an exception to the predominant Sunnah in dhikr, where the predominant Sunnah in dhikr is to keep it secret and not to raise the voice. However, there are places where this Sunnah was excepted, and raising the voice was made the Shari'ah ruling. The takbir of the festivals is of this nature, with the distinction I mentioned earlier. The point is that the takbir on 'Id al-Adha is for all four days, aloud and not secretly. However, it is not from the Sunnah to restrict the takbir of the festival to after the prayers. Rather, it is prescribed to raise the voice with the takbir in every hour of the four days of the festival. As for restricting it to after the prayer, that has no basis. Therefore, we should not treat the disease with the disease. That is, if the people have committed to taking the takbir aloud after the prayers, and this has no basis in the Sunnah, we do not forbid them because they have committed to it, but we forbid them because they have turned away from the takbir in all times and restricted this time, which is after the prayer, to the takbir. This restriction is what has no basis. So we tell them: Take the takbir and raise your voices with the takbir on all days of the festival, before the prayer, after the prayer, between the prayers, at night, by day, and so on. This is the answer to what you asked me.

The questioner : It is permissible here to take the takbir even before the iqamah of the prayer.

The Shaykh : All times, without committing to a specific thing, all times. This is a rare Islamic phenomenon in all the days of the year. So every dhikr follows what has been transmitted: secretly, secretly; aloud, aloud. For example, the talbiyah in Hajj and 'Umrah, the Sunnah in it is to raise the voice, and not only to raise the voice, but to exaggerate in raising the voice. Therefore, it came in some authentic hadiths that the Companions (may Allah be pleased with them), when they performed Hajj with the Prophet (peace and blessings be upon him), as Anas ibn Malik says:
They were shouting the talbiyah with a shout until كانوا يصرخون بالتلبية صراخا حتى
In another narration,
their voices became hoarse when they reached al-Rawhah بحت أصواتهم حينما وصلوا إلى الروحاء
This is contrary to the original rule. The original rule in all dhikr is to keep it secret and lower the voice. But the talbiyah in Hajj, and likewise the takbir in the festival, is contrary to this original rule. Therefore, it came regarding the talbiyah in Hajj, when the Prophet (peace and blessings be upon him) was asked about the best of Hajj, he said:
The best of Hajj is thaj and 'ajأفضل الحج الثج والعج
Thaj and 'aj. Thaj is slaughtering and offering, and 'aj is the 'ajij, which is raising the voice with the talbiyah.
Then, as they say, one thing reminds of another. I draw your attention to the fact that the talbiyah is not limited to Hajj or 'Umrah only, but they also used to say "Allahu Akbar" (tahlil). So, if they say "Allahu Akbar" in Hajj, they also raise their voices. This is specific to Hajj, and likewise 'Umrah. Although it came in the two Sahihs from the narration of Abu Musa al-Ash'ari (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) was returning from a journey, and his Companions, whenever they ascended a high place, raised their voices, and when they descended a valley, raised their voices. So he said to them (peace and blessings be upon him):
O people, be gentle with yourselves. The One you are calling is not deaf nor absent. The One you are calling is closer to you than the neck of your mount. You are only calling One who is Hearing and Seeing. أيها الناس اربعوا على أنفسكم إن الذي تدعون ليس بأصم ولا غائب, إن من تدعون أقرب إلى أحدكم من عنق راحلته إليه, إنما تدعون سميعا بصيرا
The point is that he (peace and blessings be upon him) disapproved of them in this journey of raising their voices with tasbih and takbir. Tasbih when they descended a valley, and takbir when they ascended a high place. He drew their attention to the fact that the original rule is not to raise the voice, and he said, "Be gentle with yourselves":
Be gentle with yourselves. The One you are calling is not deaf nor absent ... اربعوا على أنفسكم إن الذي تدعون ليس بأصم ولا غائب ...
As-Sunan al-Kubra lil-Nasa'i 62:242
to the end of the hadith. So, is that original rule applied to this branch, which is the talbiyah aloud and tahlil aloud in Hajj and 'Umrah? The answer is: No. This is the requirement of pure, sound following, free from all the impurities of shirk in the message. Just as we perform the five prayers, some secretly, some aloud, some secretly and aloud, or aloud and secretly. Why?
and they greet with a greeting ويسلموا تسليما
This is how we were taught and this is how it was passed to us, so it is up to us only to follow. Therefore, it was said:
"All good is in following those who came before, and all evil is in the innovation of those who came after."
The Shaykh : other than it.
